2. Scope
These Terms and Conditions of Sale (“Terms”) govern all sales concluded between KAMELEON and any person making a purchase on the KAMELEON website.
By placing an order, you accept these Terms in full, without qualification and without reservation.
3. Products
The products offered are those displayed on the website on the date of your order, subject to availability.
Photographs, videos, illustrations and descriptions are provided for guidance only. Despite the care taken in their presentation, slight differences in colour, dimensions, packaging or finish may exist depending on screen settings, manufacturing batches or suppliers, and the Seller shall not be liable for such differences.
The Seller reserves the right to modify the specifications of its products at any time, without affecting orders that have already been confirmed.
Origin:
KAMELEON is a French company based in Paris, where our research, design and marketing activities are carried out. Some of our products originate from South Korea, a country recognised worldwide as a benchmark for cosmetics, for its expertise and innovation. The packaging of our products is manufactured in China.
4. Prices
Prices are stated in euros (€) and are inclusive of all applicable taxes.
The Seller reserves the right to amend its prices at any time.
The price applicable to your order remains the price displayed at the time your order is confirmed.
Any delivery charges are shown before payment.
5. Orders
Your order becomes final once you have:
- confirmed your basket;
- accepted these Terms; and
- made payment in full.
A confirmation email will be sent to you.
The Seller reserves the right to refuse, suspend or cancel any order, in particular in the event of:
- suspected fraud;
- incomplete or inaccurate information;
- a prior dispute with the customer;
- abuse of the returns policy; or
- non-payment or a payment incident.
6. Payment
Payment is due immediately.
The payment methods offered on the website are secure.
The Seller never has access to the customer’s banking details.
Orders will be dispatched only once payment has been successfully confirmed.
7. Delivery
Orders are dispatched to the address provided by the customer.
Estimated delivery times:
- European Union: 6 to 10 working days
- International (including the United Kingdom): 6 to 10 working days
These times are estimates only.
They may be extended, in particular, because of:
- high demand;
- adverse weather conditions;
- customs checks;
- industrial action;
- an event of force majeure; or
- logistical difficulties beyond the Seller’s control.
The Seller shall not be liable for any delay attributable to the carrier or to any circumstance beyond its control.
Risk in the goods passes to you when you, or a third party nominated by you, take physical possession of the goods. For customers in the United Kingdom, this is in accordance with section 29 of the Consumer Rights Act 2015; for customers in France, it is in accordance with Article L216-4 of the French Consumer Code.
8. Right to Cancel
You have a statutory right to cancel your order within fourteen (14) days beginning on the day on which you receive the goods, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (or, for customers in France, Articles L221-18 et seq. of the French Consumer Code).
Full details are set out in the website’s Returns and Refunds Policy.
The costs of returning the goods remain the responsibility of the customer, unless otherwise provided by law or by KAMELEON’s commercial policy.
9. Faulty Goods
Any claim in respect of goods that are damaged, incomplete or faulty must be notified within forty-eight (48) hours of receipt of the parcel, accompanied by photographs showing the defect.
Failing this, the claim may be rejected where the delay makes it impossible to verify the origin of the damage.
Following examination, the Seller will offer, as appropriate, either a replacement or a refund.
This clause does not affect your statutory rights, including your rights under the Consumer Rights Act 2015.
10. Statutory Guarantees
The products sold benefit from the statutory guarantees provided by Articles L217-3 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code (hidden defects) and, for customers in the United Kingdom, from your statutory rights under the Consumer Rights Act 2015, including the requirements that goods be of satisfactory quality, fit for purpose and as described.
11. Liability
The Seller’s obligations in relation to the operation of the website and the performance of its services are obligations of reasonable endeavours only.
The Seller shall not be liable, in particular, in the event of:
- use of the product otherwise than in accordance with its intended purpose;
- normal wear and tear;
- negligence or mishandling;
- modifications made by the customer;
- loss or delay attributable to the carrier;
- force majeure;
- temporary interruption of the website; or
- technical incompatibility with the customer’s equipment.
In any event, the Seller’s liability is limited to the amount actually paid by the customer for the order concerned, save where mandatory law provides otherwise.
The Seller shall not be liable for indirect or consequential loss, such as loss of business, loss of data, loss of profit or commercial prejudice.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
12. Personal Data
The data we collect is used exclusively to:
- process orders;
- provide after-sales service; and
- comply with legal obligations.
It is never sold.
Certain data may be disclosed only to those service providers that are essential to the fulfilment of orders (payment, transport and hosting).
Processing is carried out in accordance with the GDPR and, where applicable, the UK GDPR and the Data Protection Act 2018.
13. Force Majeure
The Seller shall not be liable for any total or partial failure to perform its obligations where this results from an event of force majeure within the meaning of Article 1218 of the French Civil Code, or from any event beyond its reasonable control, including natural disaster, pandemic, war, cyber-attack, strike, shortage, transport disruption or supplier failure.
14. Intellectual Property
All content on the website www.kameleoncosmetics.com (including text, visuals, videos, logos, graphics, trade marks, photographs, illustrations and other content) remains the exclusive property of the Seller or its partners.
Any reproduction, distribution or exploitation without prior written consent is strictly prohibited.
15. Disputes and Governing Law
These Terms are governed by French law, without prejudice to any mandatory consumer protection rights that you may have under the law of the country in which you live.
In the event of a complaint, the customer is invited first to contact our customer service team with a view to reaching an amicable resolution.
Failing amicable agreement, the French courts shall have sole jurisdiction, subject to the mandatory provisions applicable to consumers, including any right you may have to bring proceedings in the courts of your country of residence.
